General Terms and Conditions of Sale

The website mistikmountain (the “Website”) is operated by Mistik Mountain SAS, a SAS registered under number 918 452 763, with its registered office at 65 Rue de la Montagne, 69005 Lyon, France, VAT number FR56918452763, email address [email protected], and telephone number +33 4 55 79 10 08 (the “Seller”).

These General Terms and Conditions of Sale (“Terms”) apply to all purchases made through the Website. By placing an order, the customer confirms that they have read and accepted these Terms without reservation.

Article 1 – Products

The essential characteristics, descriptions, images, dimensions, materials, and prices of the products are presented on the Website. Product images are provided for illustrative purposes and may differ slightly from the delivered product, particularly in color or appearance, without affecting its essential characteristics.

Products are offered subject to availability. If a product becomes unavailable after an order has been placed, the Seller will inform the customer as soon as possible and offer either a replacement, where accepted by the customer, or a full refund of the unavailable product.

Article 2 – Prices

Prices are displayed in euro and include all applicable taxes unless expressly stated otherwise. Delivery charges, customs duties, import taxes, and any other additional costs are not included in the product price unless specifically indicated.

Any delivery charges and other applicable fees will be clearly displayed before the customer confirms the order and payment.

The Seller may change prices at any time. Products are invoiced at the price displayed when the order is confirmed. In the event of an obvious pricing or technical error, the Seller may cancel the affected order and refund all amounts paid.

For deliveries outside the Seller’s customs territory, the customer may be required to pay customs duties, import taxes, or local charges upon delivery. These charges are the customer’s responsibility and are determined by the authorities of the destination country.

Article 3 – Orders

To place an order, the customer must select the desired products, add them to the shopping cart, provide accurate billing and delivery information, choose an available delivery method, and complete payment.

Before submitting the order, the customer will have the opportunity to review and correct the order details. By clicking the final order or payment confirmation button, the customer submits a binding order and accepts these Terms.

An automatic acknowledgment may be sent after the order is submitted. The sales contract is concluded when the Seller sends an order confirmation or dispatch confirmation, depending on the wording shown during checkout.

The Seller reserves the right to refuse or cancel an order for legitimate reasons, including suspected fraud, unauthorized payment, inaccurate customer information, abnormal quantities, product unavailability, an obvious pricing error, or an unresolved dispute concerning a previous order. Any payment collected for a canceled order will be refunded.

The customer is responsible for ensuring that all information provided when ordering is complete and accurate. The Seller is not responsible for delays or failed deliveries caused by incorrect or incomplete information supplied by the customer.

Article 4 – Payment

Payment must be made using one of the payment methods displayed at checkout. The available methods may include debit or credit cards and other payment options supported by Stripe.

Payments are securely processed by Stripe or another payment service provider identified at checkout. Payment card details are submitted directly to the payment provider and are not stored by the Seller. Stripe’s own terms and privacy policy may also apply to the processing of payment data.

The Seller remains the merchant responsible for the sale, fulfillment, customer service, cancellations, returns, and refunds relating to orders placed on the Website.

The customer confirms that they are authorized to use the selected payment method. An order may be suspended or canceled if payment is declined, reversed, unauthorized, or flagged as potentially fraudulent.

Payment may be authorized when the order is submitted and captured immediately or when the order is accepted or dispatched. The timing applicable to the transaction will be indicated during checkout or by the selected payment method.

If a payment is made in a currency different from the currency of the customer’s account, the customer’s bank or payment provider may apply exchange rates or additional fees. Such charges are outside the Seller’s control.

Article 5 – Delivery

Products are delivered to the address provided by the customer during checkout. Available delivery areas, methods, charges, and estimated delivery times are displayed before the order is confirmed.

Delivery times are estimates unless a specific binding date has been expressly agreed. The Seller will process and dispatch orders within 2 to 4 business days, subject to product availability, payment authorization, weekends, public holidays, and circumstances beyond the Seller’s reasonable control.

If delivery is significantly delayed, the customer may contact the Seller at [email protected]. Where required by applicable law, the customer may request delivery within an additional reasonable period and cancel the order if the Seller does not deliver within that period. A refund will then be issued for the canceled products and related standard delivery charges.

The customer must inspect the parcel and products promptly after delivery. Visible damage, missing items, or delivery errors should be reported to the Seller as soon as possible, together with the order number and supporting photographs where appropriate. Reporting deadlines do not limit the customer’s mandatory statutory rights.

Risk of loss or damage passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, physically receives the products. If the customer independently appoints a carrier not offered by the Seller, risk passes when the products are handed to that carrier.

Article 6 – Right of Withdrawal

If the customer is a consumer located in the European Union, European Economic Area, or another jurisdiction providing an equivalent right, the customer may withdraw from the purchase without giving any reason within 14 days from the day on which the customer, or a designated third party other than the carrier, receives the products.

For an order containing several products delivered separately, the withdrawal period begins when the final product is received.

To exercise the right of withdrawal, the customer must send an unambiguous statement before the withdrawal period expires to:

The customer may use the following wording, although it is not mandatory:

“I hereby give notice that I withdraw from the contract for the sale of the following product(s): Mistik Summit Throw Blanket. Ordered on 12 July 2026 and received on 16 July 2026. Order number: MM-2026-0712-4581. Customer name and address: Annabelle Chotard, 18 Rue des Tilleuls, 44000 Nantes, France. Date: 20 July 2026.”

The customer must return the products within 14 days after notifying the Seller of the withdrawal. Products must be returned with reasonable care and, where possible, with their accessories and original packaging.

The customer bears the direct cost of returning products unless the Seller agrees otherwise, the products are defective or incorrect, or applicable law requires the Seller to bear those costs.

The Seller will refund the price paid and the cost of the least expensive standard delivery method offered at checkout. Additional costs resulting from the customer’s choice of a more expensive delivery method are not refundable.

The refund will be issued within 14 days after the Seller is informed of the withdrawal. The Seller may withhold the refund until the returned products are received or the customer provides evidence that they have been sent back, whichever occurs first. Refunds are made using the original payment method unless the customer expressly agrees otherwise and will not incur additional refund fees from the Seller.

The customer may be responsible for any reduction in value caused by handling beyond what is necessary to establish the nature, characteristics, and functioning of the product.

The right of withdrawal may not apply to:

  • products made to the customer’s specifications or clearly personalized;
  • products liable to deteriorate or expire rapidly;
  • sealed products that are unsuitable for return for health protection or hygiene reasons after being unsealed;
  • sealed audio, video, or software products after being unsealed;
  • digital content supplied without a physical medium once performance has begun with the customer’s prior express consent and acknowledgment that the right of withdrawal will be lost; or
  • other products or services excluded by applicable law.

Any voluntary return policy offered by the Seller is additional to, and does not replace or restrict, the customer’s statutory right of withdrawal.

Article 7 – Refunds

Approved refunds are sent to the original payment method through Stripe or the relevant payment provider. Although the Seller initiates refunds promptly, the time required for the refunded amount to appear may depend on the customer’s bank, card issuer, or payment provider.

Shipping charges are refundable only where stated in these Terms or required by applicable law. Return shipping costs and non-standard delivery surcharges are not refundable unless the return results from a defective, damaged, or incorrect product.

Article 8 – Legal Guarantees

Products are covered by all mandatory legal guarantees applicable in the customer’s country of residence, including the legal guarantee of conformity and the guarantee against hidden or latent defects where applicable.

For consumers covered by European Union or French consumer law, the Seller is responsible for a lack of conformity that becomes apparent within two years from delivery, subject to the conditions and presumptions provided by applicable law.

If a product is defective, damaged, not as described, or not fit for its normal purpose, the customer may be entitled to repair or replacement free of charge. If repair or replacement is impossible, disproportionate, not completed within a reasonable time, or causes significant inconvenience, the customer may be entitled to a price reduction or cancellation and refund, subject to applicable law.

The legal guarantee against hidden defects may entitle the customer to cancel the sale or obtain a reduction in price where a hidden defect existing at the time of sale makes the product unfit for its intended use or substantially reduces that use.

Legal guarantees apply independently of any commercial warranty offered by the Seller or manufacturer. Nothing in these Terms excludes or limits mandatory consumer rights.

The customer should provide the order number, contact details, a clear description of the issue, and any relevant photographs or supporting documents. The Seller will acknowledge and process complaints within a reasonable time.

If a consumer complaint cannot be resolved directly, the customer may have the right to use an independent consumer mediation or alternative dispute resolution service. The competent mediator for the Seller is:

Recourse to mediation is voluntary and does not prevent the customer from bringing a claim before a competent court.

Article 10 – Liability

The Seller is responsible for the proper performance of its obligations under the sales contract, subject to applicable law.

The Seller will not be liable for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, severe weather, strikes, transportation interruptions, governmental measures, epidemics, network failures, or failures of third-party services. This provision does not affect rights that cannot legally be excluded.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, defective products where liability is mandatory, or any other liability that cannot be excluded under applicable law.

Article 11 – Personal Data

Personal data is processed to manage orders, payments, deliveries, customer service, fraud prevention, and legal obligations. Further information about how personal data is collected, used, stored, and shared is available in the Website’s Privacy Policy.

Payment information is processed by Stripe or another payment provider in accordance with that provider’s privacy policy and applicable data protection laws.

Article 12 – Intellectual Property

All Website content, including trademarks, names, text, images, graphics, logos, product descriptions, and designs, is protected by intellectual property laws. It may not be copied, reproduced, modified, distributed, or commercially used without prior written permission from the relevant rights holder.

Article 13 – Applicable Law and Jurisdiction

These Terms and all sales made through the Website are governed by the laws of France, without depriving a consumer of any mandatory protection granted by the laws of the country in which the consumer habitually resides.

Any dispute will be submitted to the competent courts determined under applicable law. Consumers may bring proceedings before the courts of their place of residence where mandatory consumer law permits.

Article 14 – Severability and Amendments

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

The Seller may amend these Terms from time to time. The version applicable to an order is the version accepted by the customer when the order is placed. Changes will not apply retroactively to previously confirmed orders.
